On April 2, 2021, the Council of Ministers approved the preliminary draft of the law for the sexual criminal justice reform<\/strong> approved.<\/p>\n

Op 4 mei 2021 heeft de Hoge Raad voor de Justitie<\/a> zich tevens uitgesproken over het wetsvoorstel omtrent de veranderingen van de audiovisual recording of an interrogation<\/strong>.<\/p>\n

Indeed, the Supreme Judicial Council favors the future interrogation of all <\/strong>audiovisual recording of victims and witnesses of sexual crimes.<\/p>\n

What is an audiovisual interrogation?<\/h2>\n

The term \"audiovisual\" already captures the essence of the interrogation: the interrogation is recorded, both visually and with audio.<\/p>\n

In addition, the audiovisual interrogation is always conducted in the same step-by-step manner by specialists. Special attention is paid to protection of the vulnerable interrogated person.<\/p>\n

Bij een audiovisueel verhoor is er telkens sprake van een regie- en verhoorlokaal. Het slachtoffer of de getuige mogen met hun vertrouwenspersoon<\/a> plaatsnemen in het verhoorlokaal, alwaar het effectieve verhoor zal plaatsvinden.<\/p>\n

Aangrenzend aan dit lokaal bevindt zich een regielokaal, alwaar het technisch materiaal zich bevindt. Van hieruit volgt een regisseur het verhoor mee. Hij is verantwoordelijk voor de opname van het verhoor. De verhoorder kan tijdens het verhoor ook op de regisseur terugvallen \u2013 dewelke tevens een opleiding heeft gevolgd \u2013 wanneer hij in een impasse zou raken.<\/p>\n

Other individuals such as a psychiatrist, ... may also be present in the regional office for support.<\/p>\n

For whom is the audiovisual interrogation currently used?<\/strong><\/h2>\n

Typically, the interrogation of suspects, witnesses or victims is not audiovisually recorded. The possibility exists, but it is not the rule.<\/p>\n

In doing so, the law makes the exception for minors and vulnerable adults<\/strong> which it victim<\/strong> have become or witnesses<\/strong> its from sexual offences<\/strong><\/a>.\u00a0Zij worden per definitie steeds audiovisueel verhoord.<\/p>\n

This protection was built in, among other things, because it could have the effect of allowing the transcript of that hearing or audiovisual data carriers to replace the personal appearance of the victim or witness in court.<\/p>\n

Future?<\/h2>\n

An opinion was granted by the Supreme Judicial Council on a bill seeking this exception extend to all victims or witnesses of those sexual crimes<\/strong>, including non-vulnerable adults.<\/p>\n

The SJC is already in favor of this extension, but believes that it should be implemented in a different way than the bill. The SJC invites the legislature to conduct a global reflection on this matter.<\/p>\n
